Generalterms & conditions.

Terms & conditions Privacy policy Legal notice

1. General provisions

MUC-Drive, Schusterweg 6b, 85375 Neufahrn b. Freising (hereinafter ‘MUC-Drive’), offers users the opportunity to book transport services through its own online platform. These general terms and conditions form an integral part of every agreement between the user and MUC-Drive.

2. Services

The included services comprise the vehicle, driving personnel and agreed journey mileage. MUC-Drive undertakes to provide a roadworthy vehicle meeting the requirements of the German Road Traffic Act (StVG) and Road Traffic Licensing Regulations (StVZO). Vehicles are insured under the applicable General Conditions for Motor Vehicle Insurance (AKB). The vehicle is clean at the start of the journey.

The driving personnel deployed by MUC-Drive hold the required official permits under the Passenger Transport Act (PBefG) in conjunction with its implementing regulations.

3. Conclusion of the contract

By submitting the completed booking form or making a request by telephone, the user makes MUC-Drive an offer to enter into a business services contract.

After receiving the booking request, MUC-Drive sends the user an acknowledgement by email containing details of the requested transport service. This only acknowledges receipt of the request and does not constitute acceptance of the contract.

The business services contract is concluded only when MUC-Drive expressly accepts it in a separate booking confirmation sent by email.

4. Selected provisions of the transport contract

4.1 Journey types and changes to services

Subject to availability, the user can choose between transfer journeys and hourly bookings.

If a journey differs from the original booking at the user’s or passenger’s request and involves additional effort, MUC-Drive will accommodate this where possible. Such additional effort may result in extra charges.

Subject to availability, the user or passenger may change journey arrangements after the contract has been concluded.

The previously agreed fixed price applies to transfer journeys.

An hourly booking always begins at the booked pickup time and generally ends within the city in which the pickup takes place. Additional charges apply if the included mileage or booking duration is exceeded.

4.2 Pickup time

The agreed pickup time is the time stated in MUC-Drive’s booking confirmation.

For pickups at an airport or long-distance railway station, if the user provides the correct flight or train number when booking so that arrival can be tracked, the agreed pickup time is adjusted to reflect any change in the arrival time.

4.3 Vehicle class and upgrades

Subject to availability, the user can choose from different vehicle classes, such as Business Green or Business Van XL.

The vehicles illustrated are examples only. They do not confer any entitlement to a specific vehicle model within the booked class.

Subject to availability, MUC-Drive may upgrade the vehicle class at any time at no extra cost to the user, for example from Business Green to a higher class such as Premium.

4.4 Transport safety and consequences

Luggage and animals

The price stated in the booking confirmation includes the number of items of luggage specified in the booking form.

Excess luggage, bulky luggage, weapons or animals that a passenger wishes to bring must be declared when booking. MUC-Drive may refuse to carry undeclared luggage, weapons or animals. This also applies to animals that are not placed in a suitable, closed transport carrier. There is no right to refuse carriage where local legislation in the region of transport requires such carriage.

If MUC-Drive nevertheless permits the carriage of luggage, weapons or animals not previously agreed, additional charges may apply. The remuneration for the business service is adjusted accordingly and exceeds the amount stated in the booking confirmation.

Carriage of children and minors

Children: the user must specify the number and type of child restraint systems required when requesting the journey.

Minors: MUC-Drive may refuse to carry unaccompanied minors. Whether a person is an adult or a minor is determined by the law of the region in which transport takes place.

Passenger and luggage numbers

The maximum passenger and luggage numbers stated by MUC-Drive for each vehicle class are based on estimated passenger and luggage sizes and weights and are therefore not binding. MUC-Drive may refuse carriage of passengers or luggage if it considers that space or safety conditions do not permit it.

Inability to provide transport

MUC-Drive may refuse carriage if the user has failed to provide the mandatory information required under section 4, or has provided it incorrectly.

In such cases, the inability to provide transport does not affect the remuneration payable by the user to MUC-Drive under the business services contract for that journey.

4.5 Delays

Exceptional circumstances such as air traffic controller strikes, extreme weather or similar unforeseeable events can only be compensated for to a limited extent. In such cases, users must accept longer waiting times or short-notice cancellations.

4.6 Cancellations, rebookings and no-shows

Cancellation

Transfer journeys and hourly bookings can be cancelled free of charge more than 12 hours before the agreed pickup time. Between 12 and 2 hours before pickup, half the price is payable; less than 2 hours before pickup, the full price is payable. Cancellations may be made by email or telephone.

Rebooking

Rebookings are generally treated as new bookings. The cancellation provisions also apply to the originally booked journey. MUC-Drive may retain its entitlement to remuneration for the original journey.

No-shows without cancellation and user delays

If a journey is not taken without cancellation, the user loses the right to transport, while MUC-Drive retains its right to remuneration from the user.

A journey is considered a no-show if the user or passenger fails to appear at the pickup location within 10 minutes after the agreed pickup time without cancelling.

For airport pickups, a journey is considered a no-show if the user or passenger fails to appear within 60 minutes after the agreed pickup time without cancelling; for long-distance railway stations, the period is 30 minutes.

No-show journeys must be paid in full. No waiting-time surcharges apply unless MUC-Drive and the passenger agree a later pickup time by telephone. In that case, any waiting-time surcharges must be paid. There is generally no entitlement to change the pickup time.

No-show journeys must likewise be paid in full. If MUC-Drive and the passenger agree a later pickup time by telephone, the agreed hourly-booking remuneration rules apply. Any extension to the hourly booking must be paid for. There is generally no entitlement to change the pickup time.

Conduct in the vehicle

The following rules of conduct apply to users of the transport services:

During the journey, all passengers must comply with applicable road traffic rules, particularly the obligation to wear seat belts. The driver’s instructions must always be followed, as the driver is responsible for the safe performance of the journey. Passengers must not open doors, throw objects from the vehicle, extend body parts outside it or shout during the journey. Before operating equipment or systems in the vehicle, passengers must receive instructions from the driver.

Smoking is prohibited in all vehicles. If the user or a passenger breaches this rule, the user must pay the costs of cleaning the vehicle and the resulting loss of use.

Bringing food is discouraged. Alcoholic drinks may only be brought and consumed by prior agreement.

5. Remuneration and payment

MUC-Drive’s entitlement to remuneration is stated in the booking confirmation.

The amount is based on the selected vehicle class, route, pickup time and location, and anticipated traffic delays.

Additional requests such as multilingual chauffeurs, intermediate stops, bulky luggage, individual vehicle branding or child seats may increase the price.

5.1 Changes to journeys

The user and passenger may change journey arrangements after the business services contract has been concluded and after the journey has started, insofar as MUC-Drive can accommodate this.

If the journey is extended spontaneously at the user’s or passenger’s request, for example by changing the route or number of hours, the actual service provided (total distance or duration) is recalculated after the journey according to the applicable price structure. Hourly bookings are billed in started half-hour increments: the first additional minute is rounded up to the next half hour.

This increases the remuneration payable by the user, as MUC-Drive’s reimbursement of expenses for the transport contract also increases accordingly.

If the booked distance or number of hours is reduced, the originally agreed remuneration remains unchanged.

5.2 Other surcharges

Waiting times for transfer journeys

For transfers and hourly bookings, no waiting-time surcharge applies for up to 60 minutes after the agreed pickup time at airports, up to 30 minutes at long-distance railway stations, and up to 10 minutes in all other cases. Each additional minute is charged proportionately at the hourly-booking rate for the vehicle class.

Additional mileage for hourly bookings

Hourly bookings include the mileage stated in the booking form or agreed by telephone. Mileage above this allowance is payable separately at the additional per-kilometre price stated for the vehicle class or communicated by telephone.

5.3 Payment methods and transaction fees

The user may pay online during booking by credit card, PayPal, Klarna, Amazon Pay, Google Pay or Apple Pay, or directly to the driver. MUC-Drive bears card transaction fees. Where payment on invoice has been approved in advance, payment is made directly to MUC-Drive by bank transfer. The user bears any transaction fees for bank transfers.

5.4 Reminders and failed card payments

MUC-Drive may charge a reasonable reminder fee for each payment reminder.

MUC-Drive charges the user any expenses or costs incurred for unsuccessful card payments.

5.5 Delivery of invoices and payment due dates

MUC-Drive sends the relevant invoice electronically by email or makes it available for download in the user account. Payment by credit card is due immediately. For payment on invoice or by bank transfer, the payment term stated on the invoice applies.

5.6 Vouchers

Vouchers can be redeemed once, individually, and cannot be combined with other vouchers. Cash redemption is not possible.

6. Liability

MUC-Drive is liable for damage caused intentionally or through gross negligence by MUC-Drive or its agents and assistants.

For damage caused by ordinary negligence, MUC-Drive is liable only if an essential contractual obligation has been breached. Liability is then limited to foreseeable and typical damage. Essential contractual obligations are those necessary for proper performance of the contract and on whose fulfilment the user may regularly rely.

6.1 External links

MUC-Drive accepts no responsibility for the content, legality or functionality of third-party websites linked from this site. Accessing linked pages is at your own risk.

6.2 Accuracy of transmitted information

MUC-Drive accepts no responsibility for information being correct and complete or reaching the user or MUC-Drive in time. Booking confirmations are excluded from this provision.

6.3 Forgotten or lost items

No liability is accepted for items forgotten or lost in the vehicle.

7. Final provisions

These terms constitute the entire agreement between MUC-Drive and the user concerning the services. No additional agreements exist. Changes and additions are effective only if made in text form.

7.1 Set-off, retention and assignment

The user may only offset or withhold amounts against MUC-Drive’s claims where the counterclaims have been legally established or are undisputed. This also applies to complaints about defects.

The user may not assign claims arising from the contractual relationship to third parties without MUC-Drive’s express written consent.

7.2 Applicable law and jurisdiction

If the user is a merchant, a legal entity under public law or a special fund under public law, jurisdiction and place of performance are at MUC-Drive’s registered location (Freising). The contractual language is German.

The law of the Federal Republic of Germany governs all legal relations between the parties.

7.3 Indemnification by the user

The user indemnifies MUC-Drive against all claims and costs, including reasonable legal defence costs, asserted by a third party against MUC-Drive due to a breach of these terms.

7.4 Consumer dispute resolution (section 36 VSBG)

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

7.5 Severability

If any provision of this contract is or becomes invalid or unenforceable after the contract has been concluded, the remaining provisions remain effective. The invalid or unenforceable provision is to be replaced by a valid and enforceable provision whose economic effect most closely reflects the objective pursued by the parties with the original provision. These rules apply correspondingly if the contract contains an omission.
